Assuming the semi-final scores will be wiped when the actual game starts, it's not unfair for this round in particular. It's also not as much of an issue imo if a judge doesn't vote at all in a round—honestly people might have a lot going on one week I don't think they need to be axed for it.

That said, it is a little unfair to allow a judge to vote on some and not others in a single round because due to the variance in judges' internal scoring systems it could potentially give some people an advantage/disadvantage in rankings.
